December 22, 2017
A turning point in the history of the Madrid System – Indonesia acceded to the Madrid Protocol. The Protocol will enter into force in Indonesia on January 2, 2018, as a result of which local trademark owners of Indonesia will be presented an opportunity, through the Madrid System and a single application, to protect their trademarks in the member states of the Madrid System, whereas member states of the Madrid System will be able to protect their trademarks in Indonesia.
Of the countries of the Association of Southeast Asian Nations (ASEAN), Indonesia is the eighth country to accede to the Madrid System under Article (2)(b) of the Protocol, which prescribes a time limit of 18 months for taking a decision, and Article 20 bis (6)(b) of the Common Regulations, which limits the reflection in Indonesia of a license registered in the International Register. By the accession of Indonesia, the Madrid Protocol has become already the fifth union of WIPO with more than 100 contracting parties.
