“Kindzmarauli” Export Will Have No More Problems in Mongolia
August 12, 2019
Registered Georgian appellation of origin “Kindzmarauli”, Georgian wine varieties “Saperavi”, “Rkatsiteli”, and mark “Alaznis Valley”, registered in bad faith on the territory of Mongolia by Mongolian company “’Tavanbogd International” LLC, were invalidated. The National Intellectual Property Centre of Georgia Sakpatenti carried out the necessary measures envisaged by the legislation, on the basis of the appeal of the producing and exporting company, whose export of wine to Mongolia had been restricted due to the above-mentioned registrations.
The copy of the official decision regarding the appeals, duly substantiated and grounded with relevant evidence, filed by Sakpatenti with the Chamber of Appeals of the Intellectual Property Office of Mongolia, was handed over today, on August 12, 2019.
Protection of geographical indications and appellations of origin is one of the priorities of the Government of Georgia, as their unlawful use is detrimental for the goods protected by Georgian geographical indications/appellations of origin and damages their reputation.
The disputes ending in Mongolia in favour of the Georgian party is a clear example of the effective cooperation between the state and private sectors, within which Sakpatenti provided full legal support, whereas the costs related with the disputes were borne by the Georgian company “Telavi Wine Cellar”.
