Trademark and Design Practice Papers - Sakpatenti Organizes a Seminar for Interested Parties

Today, patent attorneys, lawyers working in the intellectual property field and Sakpatenti staff members are familiarizing with the Practice Papers published by Sakpatenti. The main purpose of the seminar, organized within the EU-Georgia Intellectual Property Project (EUGIPP), is to increase transparency, legal certainty and predictability for applicants, examiners and any other interested parties regarding examination of trademark and design applications. The event was opened by Mr. Mindia Davitadze, Chairman of the National Intellectual Property Centre of Georgia Sakpatenti, and Mr. Catalin German, Deputy Head of Cooperation Section at the Delegation of the European Union to Georgia.
The seminar participants are familiarizing with various topical issues of the intellectual property field: distinctiveness of marks, figurative marks containing descriptive/non-distinctive words, scope of protection of black and white marks, likelihood of confusion, relative grounds of refusal of trademark registration and common practices of graphic representation of designs. These topics are united in the Practice Papers which Sakpatenti published this year, thereby declaring readiness to conduct examination of trademarks and designs according to the relevant European Union practice.
Sakpatenti is the first non-EU IP office which is fully aligned with the common practice developed by the IP offices of the European Union Intellectual Property Network (EUIPN). The Practice Papers are available for the public in the electronic format on Sakpatenti website both in the Georgian and the English languages. The documents are divided into two parts: the first part summarises the criteria, while the second part provides a complete explanation of the specific criteria applicable in each case.
The publication of Sakpatenti Practice Papers is a result of the joint efforts of the National Intellectual Property Center of Georgia Sakpatenti and the European Union Intellectual Property Office (EUIPO). The EUIPO and Sakpatenti cooperation within EUGIPP is financed by the European Union and serves ensuring the adequate and effective protection and enforcement of intellectual property rights in Georgia.
