Georgian
appellation of origin “Borjomi” was registered in the People’s Republic of
China on the basis of the application of the National Intellectual Property
Centre of Georgia Sakpatenti.
As
of today, the use of the appellation of origin “Borjomi” in the People’s
Republic of China without the consent of the Ministry of Environmental
Protection and Agriculture of Georgia will be prohibited.
The protection of appellations of origin in the People’s
Republic of China as well as in other countries facilitates combatting against
unlawful use of Georgian appellations and upholding their reputation.
The appellation of
Georgian mineral water “Borjomi” was registered in the People’s Republic of
China in bad faith in the name of a Chinese company. Sakpatenti appealed against
the Chinese company at the China trademark dispute resolution office and
requested cancellation of these registrations.
The dispute between the Georgian party and the Chinese company was solved in
favour of the Georgain party and the exclusive right to the appellation
“Borjomi” was granted to the Ministry of Environmental Protection and
Agriculture of Georgia.
