The Parliament of Georgia Adopted the Draft Law “On Patent Attorneys of Georgia” for the Second Reading

Today, the Parliament of Georgia adopted for the second reading the draft Law “On Patent Attorneys of Georgia”. The draft Law of Georgia, prepared by Sakpatenti, will regulate issues related to acquisition of patent attorneys qualification, registration and activity as well as issues of creation and functioning of the Association of Patent Attorneys.
It is noteworthy that on January 15 of the current year, the Agreement between the European Patent Organisation and Sakpatenti on Validation of European Patents on the territory of Georgia entered into force, which was preceded by the amendment made to the Patent Law of Georgia on May 16 of the last year. As a result, the first stage of fulfillment of the obligation assumed under the Deep and Comprehensive Free Trade Area (DCFTA) Agreement with the European Union (approximation with the EU legislation) was completed.
In the legal reality of Georgia, the institution of patent attorneys is a relatively new phenomenon. Hence, Georgian practice is quite scarce in this direction. However, at this stage, on the basis of the reform of the institution of patent attorneys, a new standard of qualification exam of patent attorneys will be introduced – the insurance of professional responsibility of patent attorneys will become compulsory.
It is important that in draft Law was prepared with active involvement of patent attorneys and most of their recommendations were reflected in the final version of the draft Law.
As a result, a totally new, modern institution will be established in the country, which will be focused on professional development and introduction of novelties, facilitating thereby better protection of intellectual property and development of the field, in general.
